RCAN Slate Of Officers Elected During its last fiscal 2002-2003 luncheon meeting held at the Country Inn Restaurant on Thursday, May 22, Roofing Contractors Association of Nevada (RCAN) members elected their fiscal 2003 – 2004 Officers And Directors. The following RCAN members were elected to serve as officers and directors for the upcoming fiscal year: President - Rick Riegert, Davey Roofing Vice President – Steve Howard, Red Rose Roofing Secretary/Treasurer – Rick Polllard, Rick’s Roofing Director – Bob Crellin, Olympic Fasteners Director – Tom Romney, Prestige Roofing Director – Mike Tocco, Mike Tocco Roofing Director – Monte Stewart, Eagle Roofing Supply Immediate Past President – Mark Paxson, Metric Roofing Luncheon Attendees Receive Legislative Update members were afforded a legislative update from Cindy Nevin, executive director, Nevada Subcontractors Association. According to Nevin, SB 241, a bill designed to alleviate the number of construction defect lawsuits in the state, was heading for passage in both houses of the Nevada Legislature. "The bill’s final draft was quite a bit different from the one originally submitted, but it’s more than we could hope for given the forces pitted against us. "Firstly, complex cases, those involving five homes or more, will not necessarily launch a lawsuit. We’ve also won the right to repair before being sued. Even though a legal action is filed for one set of problems, the contractor and subcontractor are allowed to fix a different set of problems in the same houses such as stucco or air conditioning problems, for example. Further, a builder has 30 days, or ten days where a safety threat is concerned, to make repairs. This time frame was shortened from the 150-day time span we originally wanted. As a subcontractor, if a builder fails to notify you regarding requested repairs, it’s not your responsibility. "We’re also getting a clear definition of what constitutes a construction defect based upon Insurance Task Force studies conducted last year. Some supposed ‘defects’ could be a result of poor maintenance. Now, the Nevada State Contractors Board will act as a neutral third party relating to such maintenance issues. If a construction defect case goes to court and you are found not guilty, the other side must pay all court costs, i.e. attorney and special witness fees. "In all, huge gains were achieved by the construction industry, all due to our letter-writing and telephone campaign. RCAN members deserve a great deal of credit for their support." WSRCA Annual Convention And Trade Show Brings Out The Best A host of regional roofing contractors, manufacturers and suppliers turned out for the Western States Regional Roofing Contractors Association’s (WSRCA) 29th Annual Convention and Trade Show conducted on June 1 – 4 at the Paris Hotel in Las Vegas. RCAN’s booth #831 was manned by Monte Clayton, Access Fasteners; Steve Howard, Red Rose Roofing; and C. Frederick Charles, RCAN executive director. |
